Driveway Approvals Necessary Before Work Begins

Before having a new driveway installed, or modifying your existing one, remember to lodge a Driveway Application in accordance with Section 138 of the Roads Act 1993.

Did you know that you must obtain Council approval prior to undertaking any work associated with driveways with the road reserve?

Well, you do, according to Section 138 of the Roads Act 1993.

You see, the road reserve is the entire space from the boundary from your home to your neighbour’s boundary across the road.

New driveways and modifications to existing driveways must have prior approval to ensure compliance with Australian Standards and Council specifications and to protect the safety of all road users, including pedestrians and cyclists, during and after construction.

Performing work within the road reserve without proper approval may pose a public liability or safety risk and could result in the removal of any unauthorised works.

A Driveway Application must be submitted and approved by Council before any work is commenced.

All Section 138 applications must be lodged through the NSW Planning Portal.

There are Driveway Specifications and Engineering Guidelines - Subdivision and Development Standards that must be adhered to.
